What to Know About GINA and Genetic Testing Information

Since 2014, Atlanta resident Christian Fletcher has served as CEO of LifeBrite Laboratories, an award-winning research and testing company. Signed into law in 2008, GINA was created to prevent health insurance and employment discrimination based on one’s genetic information. Under the law, protected genetic information includes genetic test results and family health history. Individuals who use genetic counseling and/or participate in genetic research are also protected.

Many people seek out genetic testing to learn more about their risk of developing specific diseases and having children with certain health conditions. Genetic testing also helps individuals make informed medical decisions and lifestyle choices, and assists healthcare professionals in providing individualized care. GINA ensures that those who use genetic testing can speak freely about their conditions and risk factors without concerns over discrimination.

In the area of health insurance, the law makes it illegal for insurers to request, require, or use any type of genetic testing when determining an individual’s eligibility for insurance coverage. Insurers are also prohibited from using genetic information or family history as a basis for establishing a pre-existing condition.

While employers do not typically have access to genetic test results, GINA also ensures protections for workers. Under the law, employers are prohibited from making any decisions affecting employment, including those related to hiring, firing, pay, promotion, and employee classification.
